1. Who we are and scope

JurisAxios Law (“the firm”, “we”) is a practice of advocates enrolled with the Bar Council of Delhi, with chambers in New Delhi. This policy applies to personal data collected through www.jurisaxios.com (see also the Terms of Use) and to data received from clients, prospective clients and other persons in the course of the firm’s professional work. For the purposes of the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the firm is the Data Fiduciary for that data.

2. Personal data we collect

We collect only the data needed for the purpose it is provided for.

  • Contact details you give us through the enquiry form, by e-mail or by telephone: name, phone number, e-mail address and a description of your matter.
  • Information required to act for you once engaged: identity and address documents, case papers, correspondence and other documents relevant to the matter.
  • Technical data collected automatically when you use the website: IP address, browser type, pages visited and cookie identifiers (see section 7).
  • We do not knowingly collect personal data from children below the age of eighteen without verifiable parental consent, except where required to act in a matter concerning a minor.

3. Purposes and lawful basis

Personal data is processed for the following purposes:

  • To respond to enquiries and carry out conflict checks before any engagement (on the basis of your consent and the legitimate purpose of responding to a request you have made).
  • To provide legal services once engaged, including filing pleadings, corresponding with courts, authorities and opposing parties, and maintaining case records (as necessary for the performance of the engagement and to comply with law).
  • To comply with legal and professional obligations, including obligations under the Advocates Act, 1961, the Bar Council of India Rules and court orders.
  • To maintain the security of the website and to improve it (legitimate purpose, using minimal technical data).
  • We do not use personal data for advertising or marketing, and we do not sell personal data.

4. Sharing of personal data

The firm does not share personal data except as necessary for the purposes above:

  • With courts, tribunals, authorities, opposing parties and their counsel, as required to conduct a matter.
  • With associate advocates, local counsel, experts, process servers and translators engaged for a matter, under obligations of confidentiality.
  • With service providers who host the website, provide e-mail and store documents, under contracts that restrict their use of the data.
  • Where required by law, court order or a lawful request of a government authority.
  • Communications between an advocate and a client are privileged under Sections 132 to 135 of the Bharatiya Sakshya Adhiniyam, 2023 (formerly Sections 126 to 129 of the Indian Evidence Act, 1872) and are not disclosed except as permitted by law.

5. Retention

Enquiry data that does not lead to an engagement is deleted within 12 months of the last communication. Client files are retained for the duration of the matter and for a further period of 8 years after its conclusion, consistent with the record-keeping periods under the Companies Act, 2013 and the Income-tax Act, 1961, or longer where required by law, limitation periods or a pending appeal. In keeping with Section 8(7) of the DPDP Act, personal data is erased once the purpose for which it was collected is no longer being served, unless its retention is required by law. Files are then securely destroyed or returned.

6. Your rights

Under the DPDP Act you have the right to:

  • Access a summary of the personal data the firm holds about you and how it is processed.
  • Request correction, completion or updating of inaccurate or incomplete data.
  • Request erasure of data that is no longer necessary for the purpose it was collected for, subject to legal retention obligations.
  • Withdraw consent where processing is based on consent, without affecting the lawfulness of processing before withdrawal.
  • Nominate another person to exercise these rights in the event of your death or incapacity.
  • Raise a grievance with the firm, and if not satisfied, approach the Data Protection Board of India.
  • To exercise any of these rights, write to the Grievance Officer named in section 9.
